Welcome to ryanpostellrealty.com (the "Site"), operated by Ryan Postell, is an Indiana real estate broker affiliated with the Belmonte Real Estate Group at Better Homes and Gardens Real Estate Connections, an independently owned and operated Better Homes and Gardens Real Estate franchise. ("we," "us," or "our"). By accessing or using the Site and any services offered through it (the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site.

1. Acceptance of Terms

By using the Site, you confirm you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization. We may update these Terms at any time, and changes take effect when posted. Continued use after changes signifies acceptance.

2. Eligibility

You must be at least 13 years old to use the Site. If you are under 13, do not use the Site without permission from a parent or legal guardian. Certain Services, including entering into a real estate representation agreement, require you to be at least 18 and legally able to contract.

3. No Brokerage Relationship Is Created by Using This Site

Using this Site, submitting a form, or exchanging messages with us does not create an agency or brokerage relationship. Under Indiana law, an agency relationship is established only through a written agreement. Until such an agreement is signed, we owe you no fiduciary duties and you should not share confidential information expecting it to be treated as such.

4. Property Listings and MLS Data

Listing information on this Site may be provided through a multiple listing service (MLS) or IDX feed and is subject to the rules of the applicable MLS. Photographs and property information are provided by the listing agent or the MLS for the area in which the property is located and may not be copied or reused without permission of the copyright owner. You agree that:

  • Listing data is provided for your personal, non-commercial use only
  • You will use it solely to identify properties you may be interested in purchasing
  • You will not scrape, redistribute, resell, or compile the data
  • Information is deemed reliable but is not guaranteed accurate by us, the MLS, or the listing broker
  • Properties may be sold, pending, or withdrawn before the Site reflects that status
  • Square footage, lot size, taxes, school assignments, and similar details should be independently verified

5. Third-Party Platforms and Tools

Portions of the Site may be powered by third-party technology providers, including property search, home valuation, comparative market analysis, mapping, analytics, and messaging tools. Those services are operated by their providers under their own terms and privacy policies, and we do not control their availability, accuracy, or data practices. Any report, estimate, or output generated by such a tool is subject to the provider's terms as well as these Terms.

6. Estimates and Valuations Are Not Appraisals

Any home valuation, comparative market analysis, mortgage calculation, or affordability estimate provided through this Site is an estimate for informational purposes only. It is not an appraisal, a loan commitment, a guarantee of value, or financial, tax, or legal advice. Actual values, rates, and payments will vary. Consult a licensed appraiser, lender, attorney, or tax professional as appropriate.

7. Acceptable Use

You agree not to:

  • Use the Site in violation of any applicable law or regulation, including the Fair Housing Act, the Civil Rights Acts, the Americans with Disabilities Act, the Equal Credit Opportunity Act, and the CAN-SPAM Act
  • Access, interfere with, or disrupt the Site, its servers, or networks without authorization
  • Upload or transmit content that is harmful, offensive, defamatory, or infringing
  • Impersonate any person or misrepresent your affiliation with any entity
  • Send unsolicited advertising, spam, or chain messages through any feature of the Site
  • Attempt to bypass security measures or access restricted areas
  • Use automated tools to scrape, harvest, or index Site content or listing data

8. Accounts and Registration

Some features may require an account. You agree to provide accurate information and to keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at ryanpostellrealestate@gmail.com if you suspect unauthorized use. We may suspend or terminate accounts at our discretion.

9. Intellectual Property

Site content, features, and functionality, including text, graphics, photography, and software, are the property of Ryan Postell, the Belmonte Real Estate Group, our licensors, our technology providers, or the applicable listing brokers, and are protected by copyright, trademark, and other laws. The Better Homes and Gardens Real Estate name and logos are trademarks of their respective owners and are used under license.

We grant you a limited, non-exclusive, non-transferable, revocable license to access the Site for personal, non-commercial use. If you submit content such as feedback or inquiries, you grant us a worldwide, royalty-free license to use it in connection with operating and improving the Site and Services.

10. Copyright Complaints

We respect the intellectual property rights of others. If you believe material on this Site infringes your copyright, send written notice to ryanpostellrealestate@gmail.com including identification of the copyrighted work, identification and location of the allegedly infringing material, your contact information, and a statement made in good faith and under penalty of perjury that you are the copyright owner or authorized to act on their behalf. Where listing photographs are involved, we will also refer the matter to the applicable MLS or listing broker. We may remove content and terminate access for repeat infringers.

11. Communications Consent

By submitting your contact information, you consent to be contacted by phone, text message, or email regarding your inquiry. Message and data rates may apply. Reply STOP to opt out of texts or use the unsubscribe link in any marketing email. We may still contact you regarding an active transaction.

12. Third-Party Links

The Site may link to third-party websites, including lender sites, listing portals, and calculators. We do not control and are not responsible for their content, policies, or practices. Your use of those sites is at your own risk and governed by their terms.

13. Fair Housing

We comply with the Fair Housing Act and the Indiana Fair Housing Act. All real estate advertised on this Site is available on an equal opportunity basis. We do not discriminate on the basis of race, color, religion, sex, disability, familial status, national origin, or any other protected characteristic.

14. Disclaimers

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, and we may suspend or discontinue it at any time without notice. While we use SSL encryption, we cannot guarantee the security of data transmitted over the internet.

15. Limitation of Liability

To the fullest extent permitted by law, we and our affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or Services, even if advised of the possibility. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed one hundred dollars ($100). Some jurisdictions do not allow these exclusions, and nothing here limits liability that cannot be limited under applicable law.

16. Indemnification

You agree to indemnify and hold harmless Ryan Postell, the Belmonte Real Estate Group, and our respective affiliates, officers, employees, and agents from any claims, losses, damages, liabilities, or expenses, including reasonable attorneys' fees, arising from your use of the Site, your violation of these Terms, or your infringement of third-party rights.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Site shall be resolved in a court of competent jurisdiction in Lake County, Indiana. If either party retains attorneys to enforce rights under these Terms, the prevailing party is entitled to recover reasonable attorneys' fees.

18. Termination

We may terminate or suspend your access to the Site at any time, with or without cause or notice. Upon termination, your right to use the Site ends immediately. Provisions that by their nature should survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law, remain in effect.

19. Severability and Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Site and supersede any prior versions. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions stay in full force.
